Revocation of Tourist Licenses in Andalusian Capitals - Major Changes to Short-Term Rental Regulations in Málaga: What Property Owners Need to Know

Junta de Andalucía has revoked licenses of 2,445 tourist apartments across the eight capital cities of the region. This action was taken at the request of the municipal governments due to non-compliance with general plans and other regulations.

Málaga Leads in Tourist Accommodation in Andalusia:

Málaga province boasts the highest concentration of tourist apartments in Andalusia, with over 39,000 units, representing nearly 4% of its total residential properties. This makes Málaga the top region in Spain for tourist accommodations, surpassing Alicante, which has 37,962 units, and the Balearic Islands with 26,507 units.


According to data from the National Statistics Institute (INE), the Centro district of Málaga city is particularly notable, with occupancy rates ranging from 18% to 29%. Despite leading in the number of tourist apartments, Málaga is slightly behind Alicante in terms of available accommodation spots, with 197,849 spots compared to Alicante's 201,492.

In relation to the total number of residential properties, tourist apartments in Málaga province constitute 3.92%, one of the highest percentages in Spain, surpassed only by a few island provinces. Notable municipalities with high percentages of tourist apartments include:

- Nerja: 13.15%

- Frigiliana: 9.12%

- Benahavís: 8.78%

- Casares: 7.78%

- Ojén: 9.21%

- Júzcar: 9.05%

4. Limit on the Number of Units Managed:

Property owners directly or through management companies will now be restricted to operat a maximum of two short-term rental units. This regulation aims to prevent large-scale property speculation and ensure that the market remains accessible to individual property owners and small investors.

- Installation smoke detectors and fire extinguishers.
